Welcome to NOL.

These Terms of Service govern your access to and use of nolbeanbags.in, including your purchase of NOL products and use of any related services.

Throughout these Terms, “NOL”, “we”, “us” and “our” refer to NOL. “You” and “your” refer to the website visitor, customer or person using our services.

By accessing our website, creating an account, placing an order or using our services, you agree to these Terms of Service and the policies referred to within them.

If you do not agree with these Terms, please do not use the website or place an order.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order through our website.

If you place an order on behalf of another person, business or organisation, you confirm that you have the authority to do so.

You are responsible for ensuring that the information you provide is accurate, complete and current.

2. Our Online Store

Our store is hosted on Shopify, which provides the ecommerce platform through which we offer our products and services.

We may update, suspend or discontinue any part of the website where reasonably necessary. We do not guarantee that every feature or service will remain available without interruption.

3. Product Information

We make reasonable efforts to present our products, materials, colours, dimensions and features accurately.

However, please note:

• Colours may appear differently depending on your screen, lighting and device settings.

• Fabric shade, weave and texture may vary slightly between production batches.

• Handmade products may have minor variations in stitching, dimensions, folds and finishing.

• The final shape of a bean bag may vary slightly depending on how the PU foam is distributed and shaped.

• Shredded PU foam naturally settles and softens with use.

• Lifestyle photographs may include furniture, accessories or décor that are not included with the product.

• Product dimensions are approximate unless expressly stated otherwise.

Reasonable variations that do not affect the product’s intended use are not considered manufacturing defects.

Please review the product title, description, material, dimensions and what is included before placing your order.

4. Skin + Core System

NOL Bean Bags are built around two parts:

• Skin: The removable outer cover.

• Core: The inner liner pre-filled with shredded PU foam.

A complete bean bag includes both the Skin and Core unless the product page clearly states otherwise.

Skins and Cores must be used only with the size and system with which they are marked as compatible.

NOL is not responsible for fit, performance or damage caused by:

• Pairing incompatible NOL sizes.

• Using a NOL Skin with an unsupported third-party insert.

• Using a NOL Core with an unsupported third-party cover.

• Filling the Skin with loose thermocol or another unapproved filling.

• Altering the Skin or Core.

• Incorrect assembly or use.

Compatibility information shown on the relevant product page should be checked before ordering a Skin-only or Core-only product.

5. Pricing & Taxes

Product prices are displayed in Indian Rupees unless otherwise stated.

Applicable taxes are included or shown during checkout as required. Shipping, COD or other service charges may be displayed separately before the order is completed.

We may update product prices at any time. A price change will not affect an order that has already been accepted by NOL.

If a product is displayed with an obvious pricing, discount or technical error, we may cancel the affected order and issue a full refund for any amount paid.

6. Payments

Payments must be completed using the payment options available during checkout.

Payment services are provided by authorised third-party payment providers. Their separate terms and privacy practices may apply to the transaction.

Cash on Delivery may be available for eligible products, order values and delivery locations. We may contact you to verify a COD order before accepting it.

We may delay, decline or cancel an order where:

• Payment is not successfully authorised.

• Required COD verification is not completed.

• The transaction is flagged for possible fraud.

• Incorrect or incomplete billing or delivery information is provided.

• We reasonably believe the order violates these Terms or applicable law.

7. Order Placement & Acceptance

Submitting an order does not automatically mean that NOL has accepted it.

After you place an order, you may receive an acknowledgement confirming that we have received the request. The order is accepted after payment or COD verification has been completed and NOL confirms that the product can be fulfilled.

We may decline or cancel an order before dispatch if:

• The product is unavailable.

• A price or product-information error has occurred.

• The delivery location cannot be serviced.

• Payment or order verification fails.

• We suspect fraudulent or unauthorised activity.

• Fulfilling the order would violate applicable law.

If we cancel a prepaid order, the amount paid will be refunded to the original payment method.

8. Product Availability

All products are subject to availability.

Products displayed as available may occasionally become unavailable because of inventory differences, production issues or simultaneous orders.

Limited editions, Artist Editions and promotional products may not be restocked after selling out.

If an ordered product becomes unavailable, we may contact you to offer:

• A suitable alternative.

• A later estimated fulfilment date.

• A refund for the unavailable product.

You are not required to accept a substitute.

9. Order Changes & Cancellations

Changes to an order may be requested within 24 hours of placing it.

No product, colour, material, address or order-detail changes are permitted after 24 hours because the order may already be in the final stages of preparation.

Cancellation requests may be raised within 48 hours of placing the order.

Orders cannot be cancelled after 48 hours.

10. Made-to-Order & Custom Products

Products identified as made-to-order, customised or custom-designed are prepared specifically for the customer.

You are responsible for reviewing and approving the relevant details before production begins, including:

• Product dimensions.

• Fabric or material.

• Colour.

• Artwork.

• Text.

• Placement.

• Other confirmed custom specifications.

Once the design or specifications have been approved and production has begun, changes may not be possible.

Made-to-order and customised products are not eligible for standard returns, exchanges or cancellations unless they arrive damaged, defective or different from the confirmed specifications.

Estimated completion dates for custom products are provided in good faith and may vary depending on the complexity of the work, material availability and production requirements.

11. Customer-Supplied Artwork & Content

If you provide artwork, graphics, photographs, logos, text or other material for a custom order, you confirm that:

• You own the material or have permission to use it.

• NOL’s use of the material for your order will not infringe another person’s copyright, trademark, privacy or other rights.

• The material is not unlawful, abusive, defamatory or otherwise prohibited.

You grant NOL a limited right to reproduce, adjust and use the submitted material only as necessary to prepare, manufacture and fulfil your custom order.

NOL will not use customer-supplied artwork in public marketing without permission, except where the material has otherwise been made publicly available by the customer and applicable law permits its use.

We may refuse artwork or customisation requests that we reasonably believe are unlawful, infringing, harmful or inconsistent with the NOL brand.

You remain responsible for claims arising from material you submit without the necessary rights or permission.

12. Artist Editions & Intellectual Property

Artist Editions may include artwork licensed to NOL by independent artists or collaborators.

Purchasing a product does not transfer ownership of the artwork, copyright, trademark or other intellectual-property rights contained in the design.

Artist Edition products are sold for personal use. You may not reproduce, copy, scan, print, manufacture, distribute or commercially exploit the artwork without written permission from the relevant rights holder.

13. Shipping & Delivery

Shipping timelines are estimates and may vary depending on:

• Product availability.

• Production time.

• Delivery location.

• Courier capacity.

• Weather, transport or regional disruptions.

• Events outside NOL’s reasonable control.

Tracking details will be shared after the order has been dispatched.

You are responsible for:

• Providing a complete and accurate delivery address.

• Providing a reachable phone number.

• Being available or arranging for someone to receive the package.

• Checking access restrictions that may affect delivery.

NOL is not responsible for delays or additional charges caused by an incorrect address, unavailable recipient, restricted access or circumstances outside our reasonable control.

14. Returns, Exchanges & Refunds

Returns, exchanges and refunds are governed by our separate Returns, Exchanges & Refunds Policy.

The policy includes different return-logistics terms for the Skin and Core because the Core is a large, filled product.

By placing an order, you agree to review the eligibility conditions, return costs, packaging requirements and timelines described in that policy.

Nothing in these Terms limits any return, refund or replacement rights available under applicable consumer law.

15. Warranty

Eligible NOL products include a one-year limited warranty against verified manufacturing defects in materials and workmanship.

Normal wear and tear, accidental damage, misuse, incorrect care and natural PU foam settling are not covered.

Warranty claims and resolutions are governed by our separate Warranty Policy.

16. Promotions, Discounts & Free Gifts

Promotions, discount codes, bundles and free gifts may be subject to additional conditions displayed with the offer.

Unless otherwise stated:

• Only one discount code may be applied to an order.

• Offers cannot be applied retrospectively.

• Promotions may be limited by product, location, quantity or date.

• Discount codes have no cash value.

• Free gifts are subject to availability.

• Promotional offers may be withdrawn or changed before an order is placed.

If an order containing a free gift is returned, the unused free gift must also be returned. If it is not returned, its stated value may be deducted from the refund where permitted by law.

17. Customer Accounts

You may be required to create or access a customer account to manage orders, returns, exchanges, warranty claims or support requests.

You are responsible for:

• Keeping your account details accurate.

• Protecting your login credentials.

• Restricting unauthorised access to your device or account.

• Informing us if you suspect unauthorised activity.

You are responsible for activity carried out through your account unless the activity resulted from a security failure attributable to NOL.

We may suspend or restrict an account where we reasonably suspect fraud, misuse or a violation of these Terms.

18. Reviews & User-Submitted Content

If you submit a review, photograph, video, comment or other content directly to NOL, you confirm that:

• The content is accurate and based on your genuine experience.

• You own the content or have permission to submit it.

• It does not violate another person’s rights.

• It is not unlawful, abusive, misleading or fraudulent.

You grant NOL a non-exclusive, royalty-free right to display, reproduce and share content submitted for publication through our website and NOL-owned marketing channels.

We may moderate or remove content that violates these Terms, applicable law or platform guidelines. We will not remove a genuine negative review solely because it is unfavourable.

19. Intellectual Property

The NOL website and its contents—including product designs, text, graphics, photographs, videos, logos, icons, layout and branding—are owned by or licensed to NOL.

You may view and use the website for personal shopping and informational purposes.

You may not, without written permission:

• Copy or reproduce website content.

• Use NOL product images commercially.

• Copy or manufacture NOL product designs.

• Scrape, extract or systematically collect website data.

• Modify or create derivative works from NOL content.

• Use NOL trademarks, branding or artwork.

• Resell digital content obtained from the website.

No rights are granted except those expressly stated in these Terms.

20. Prohibited Uses

You may not use the website or our services:

• For an unlawful or fraudulent purpose.

• To infringe intellectual-property or privacy rights.

• To submit false or misleading information.

• To transmit malware or harmful code.

• To interfere with the security or operation of the website.

• To gain unauthorised access to another account or system.

• To scrape, mine or automatically extract website content.

• To impersonate another person.

• To harass, abuse or threaten another person.

• To place fraudulent, abusive or intentionally false orders.

• To misuse discount codes, returns, refunds or promotional offers.

We may restrict access, cancel affected orders or take other appropriate action where these Terms are violated.

Our website may use or link to third-party services, including payment providers, delivery partners, social-media platforms and external websites.

NOL does not control and is not responsible for the independent content, availability, security or practices of third-party services.

Your use of a third-party service may be governed by that provider’s own terms and privacy policy.

22. Website Accuracy & Availability

We aim to keep the website accurate and available, but we do not guarantee that:

• The website will always operate without interruption.

• All errors will be corrected immediately.

• Every product will remain available.

• Information will always be free from typographical or technical errors.

We may correct errors, update information or cancel an affected order where reasonably necessary.

23. Limitation of Liability

To the maximum extent permitted by law, NOL will not be responsible for indirect, incidental or consequential losses arising from the use of the website or products.

Where NOL is legally responsible for a claim relating to an order, our maximum liability will not exceed the amount paid for the affected product, unless applicable law requires otherwise.

NOL is not responsible for loss or damage caused by:

• Misuse of a product.

• Failure to follow assembly or care instructions.

• Unauthorised alterations or repairs.

• Use of incompatible Skins, Cores or third-party components.

• Events outside our reasonable control.

• Third-party services not controlled by NOL.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including applicable consumer rights.

24. Indemnification

To the extent permitted by law, you agree to compensate NOL for reasonable losses, claims or expenses arising directly from:

• Your unlawful use of the website.

• Your material breach of these Terms.

• Customer-supplied content that infringes another person’s rights.

• Fraudulent or intentionally misleading information provided by you.

This section does not apply to losses caused by NOL’s own negligence, misconduct or breach of law.

25. Events Beyond Our Control

NOL will not be responsible for delays or failure caused by events outside our reasonable control, including:

• Natural disasters.

• Severe weather.

• Transport or courier disruptions.

• Strikes.

• Government restrictions.

• Internet or payment-network failures.

• Material shortages.

• Public emergencies.

• Other force-majeure events.

We will make reasonable efforts to communicate material delays and fulfil or resolve affected orders.

The latest version will be published on this page with the updated revision date.

Changes will apply from the date of publication and will not retroactively change the material terms of an order already accepted, unless required by law.

29. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

The affected provision will be interpreted or limited only to the extent necessary to make it valid and enforceable.

30. No Waiver

If NOL does not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

31. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Subject to any rights available under applicable consumer law, disputes relating to these Terms, the website or an order will be subject to the jurisdiction of the courts in Bengaluru, Karnataka.
